CABIN PCT1425 ASSUMPTION OF RISK, WAVIER AND RELEASE OF INDEMNIFICATION AGREEMENT
PLEAE READ CAREFULLY. By signing this document, you are giving up substantial legal rights.
For the purposes of this document, Ryan Lueders and Family and Cabin Members are referred to as “Releasees,” and visitors, guests are referred to as “Participants.” All Participants must read, sign, and return this document BEFORE access is gained to the State of Texas Cabin PCT1425 and grounds. Activities may include but are not limited to, fishing, boating, sleeping, cooking, fileting fish, hunting or other cabin and fishing related events or activities in the Laguna Madre area. In consideration of the “Participant” having been provided the opportunity to participate in the above-Activity and, in the case of a minor participant, his/her parent or guardian (collectively the “Participants”) hereby voluntarily agree as follows:
ASSUMPTION OF THE RISKS. Participants are aware of and understand the inherent risks, dangers and the potential for injury that exists, and agree to assume all risk of and responsibility for personal injury or death to, or damage to or loss of property of the Participants arising from or relating to participation in the Activity. Such assumption of risk includes, but is not limited to, any personal injury or death, or damage to or loss of property, arising from, based upon or relation to the lack of skill or improper conduct of any Participant, the acts or omissions of any parent, child or visitor, and any personal injury or death, or damage to or loss of property, caused in whole or in part by the negligence of any. Each of the Participants understand and agree that, in the event of any injury to the Participant or Participants, none of the Releasees will be responsible for any decisions relating to medical treatment or for such treatment itself.
WAIVER AND RELEASE OF LIABILITY AND INDEMNIFICATION. I knowingly, voluntarily and expressly waive any and all claims I, my next of kin, heirs, guardians, representatives, assigns or any other person claiming under me completely and without reservation that I may have against Ryan Lueders and Family and Cabin Members from any and all injuries or damages that I may sustain including death as a result of me conducting Activities. Also, I, my next of kin, heirs, guardians, representatives, assigns or any other person claiming under me, forever release, waive, discharge and covenant not to sue Ryan Lueders and Family, Cabin Members, his agents, officers, members, employees, instructors, volunteers, or representatives for any personal injury, death, disability, property damage, property theft or acts and/or omissions of whatsoever kind and nature including, but not limited to, those caused by its negligence or other acts including, but not limited to, those acts and/or omissions of other participants or persons.
REPRESENTATIONS. Participants state that the Participant is in good physical condition, is physically fit to participate in the Activity and is not subject to any medical condition that may pose any risk of harm or disability to others.
By signing below, I hereby certify that I have read this agreement, understand it, accept all of its provisions, and voluntarily agree to be bound by it.
